On February 10, 2025, Judge Badalamenti issued and Order to Show Cause to the State.
It will be interesting to see if the State finally concedes, or if they actually make an attempt to refute the facts. Keep in mind it was the State who provided the facts to Costello that he relied on to file this Petition of Writ for Habeas Corpus. Given this information came from them in discovery, none of us see how they can refute this information.
